The concerns raised in Germany, Austria, France and Switzerland regarding the design of the existing provisions on arson are manifold. The diversity of the provisions in force offers an opportunity to examine arson offences from a new perspective. In particular, the study scrutinises the justification of the element of criminal damage to property in light of the character of arson offences as offences creating a common danger. By comparing the regulations of the various countries, a proposal for a provision is developed that is intended to address the concerns raised in the best possible way.
