Rules on the production royalty (Förderabgabe) are found in the Federal Mining Act (Bundesberggesetz). In Section 32 of the Federal Mining Act, the federal legislator empowers the state governments to enact certain provisions relating to the production royalty by means of statutory ordinance. The state governments may delegate this authorisation to other bodies. Most state governments have made use of this authorisation. Some of the state governments have delegated the authorisation to other bodies.
