The background of this study is a process of political upheaval in Bolivia which, following politically and economically unstable years at the beginning of this millennium, first led to a change of government and finally to a conflict-ridden process of constitutional reform. The new government promised a political reorganisation (“refoundation”) of the state system by means of a Constituent Assembly, with whose help a constitution was to be drawn up that would take account of Bolivia’s cultural pluralism on an equal footing. Within the framework of the analysis of this reform process, which focuses principally on the years 2006 to 2009, attention is directed to the question of whether the effects on the legal relationship between the indigenous population and the Bolivian state permit us to speak of a realignment of the state. The work, situated in the field of state and constitutional law, is complemented by comparative constitutional, historical and political science accounts. The particular role of the constitution and the handling of written law in the Bolivian context, which is at times unusual for a German observer, are kept in view, so that, in addition to the analysis of the concrete events, an assessment is made of the function of the constitution and its reform process in Bolivia.
