In addition to the historical development of the principle of mutual recognition as an instrument for overcoming import barriers erected at national level, the study presents its mode of operation and the conditions for its application. In the efforts to enforce the principle, the focus is in particular on the Regulation “on mutual recognition” in force since 2009. It lays down how the authorities of the Member States are to proceed when verifying the conformity of products with national technical rules. The study analyses, among other things, which regulatory option is pursued by the Regulation in relation to the principle of mutual recognition developed by the case law, how the substantive-law connection is established, and how the core provisions are structured.
