The right to one’s own image presents itself as a personality right which, derived from human dignity, is aimed at protecting the integrity (“dimensión moral”) of persons. It confers on its holder a right to determine the use of his or her graphic information in the form of his or her personal physical features, which could be disseminated publicly. This right, insofar as it is a fundamental right, consists essentially in prohibiting the obtaining, reproduction or publication of one’s own image by an unauthorised third party, irrespective of the aim pursued by that party – be it informative, commercial, scientific, cultural, etc.
