The present study examines the topic of the criminal prosecution of violations of international law. To this end, it explores the international crimes of genocide, crimes against humanity, war crimes, and, in outline, the crime of aggression. It begins with an overview of the development of international criminal law and the emergence of the Rome Statute, which defines and criminalises the aforementioned crimes and thus forms the basis for the permanent International Criminal Court (ICC) in The Hague. The involvement of Germany and South Korea in drafting the Rome Statute is discussed, as is the implementation of this international treaty into national law through the German and the South Korean Code of Crimes against International Law (Völkerstrafgesetzbuch, VStGB). A comparison of the two legal texts is undertaken. In this regard, the study addresses the points on which action is still required on the part of the two states or the ICC.
