Leaving the scene of an accident without permission under § 142 of the German Criminal Code (Strafgesetzbuch) – colloquially known as “hit-and-run” – is a criminal offence of particular relevance to both practice and academic study. Over many decades, the provision was shaped above all by the courts in a way that considerably extended criminal liability. This development culminated in a decision of the Federal Constitutional Court of 19 March 2007, which found a judicial practice lasting some 50 years to be unconstitutional.

This book provides an in-depth commentary on § 142 of the German Criminal Code. The focus of the presentation is on the group of cases involving unintentional unauthorised departure from the scene of an accident. These are cases in which the “offender” leaves the scene of the accident without knowing – for whatever reason – that he or she was involved in an accident at all.

The present book is aimed at students at universities and at universities of applied sciences with a policing focus, as well as at trainee lawyers (Rechtsreferendare) and practitioners.
