Electrical energy is always a focus of state action and is of essential importance for the existence and prosperity of modern societies. Against this background, the aim of European and German energy policy is to create a regulatory framework and to adopt measures that contribute to promoting and increasing competition. These measures include unbundling under energy law. Its purpose is to achieve the independence of network operators from other areas of energy supply activity in order to ensure greater transparency and a non-discriminatory organisation of network operations (cf. § 6 (1) EnWG). In connection with the current challenges facing the electricity industry, however, the question arises whether unbundling may have an inhibiting effect on these. The author examines this problem with regard to the expansion of transmission networks and the network integration of renewable energies, the increase in energy efficiency through the development of distribution networks into “smart grids”, and the promotion of electricity storage technology.
